When do I need to see a personal injury attorney?
If you have been injured in an accident where another party was at fault and believe that you may have a case, you should speak to a competent attorney as quickly as possible. However, it’s also true that not all instances of a personal injury necessarily call for legal representation. Especially with firms like ours that work on a contingency fee basis, it’s important to be confident of a successful outcome before proceeding with legal counsel. Prior to making a determination, we look at a number of aspects of the case. Is there enough evidence to persuade a judge or jury that the other party was actually at fault? How serious is the injury and what are its long term impacts?
Finally, we have to look at the amount of assets that the at-fault party has access to. This is what you might call the “blood from a turnip” factor. For example, many drivers carry only the minimum amount of $15,000 per person in liability insurance because they actually have few assets to protect. In this instance, the amount of money available is nearly always only going to be $15,000 for an individual victim. Of course, affluent individuals and businesses have much more to protect and will typically carry a great deal more insurance to protect their significantly larger assets… and, even if they don’t, they are still liable. Corporations, of course, invariably carry significant insurance.
For example, as billion dollar businesses, ridesharing companies Uber and Lyft typically provide $1 million worth of insurance for their drivers while they are on the job. Obviously, this makes receiving sufficient compensation very achievable for skilled legal counsel. (Importantly, this applies not only to paying passengers or people in other vehicles where the ridesharing driver is at fault, but also to Uber and Lyft drivers where another drive is at fault.)
